Divorce mediation
Is a process in which parties try to settle their divorce with the help of a neutral third party, without going to court. This method is especially beneficial in contested matters of divorce.
Uncontested divorce
An uncontested (or unopposed) divorce is a less expensive type of divorce as it is one in which you and your spouse have worked together to agree on the terms of your divorce. Both you and your spouse will appoint us as your attorney to institute the divorce.
In an uncontested divorce, both parties reach agreement on all aspects relating to the divorce, including how to divide your assets, and if there are any children, agreement is reached on matters relating to them. We will draft a settlement agreement signed by both spouses. A court date is then obtained and there is no formal trial.
Contested divorce
A contested (or opposed) divorce is one in which the parties are unable to reach agreement on various aspects of the divorce including: division of their assets; matters relating to primary residence & other aspects of their minor children; and the payment of maintenance to a spouse. The matter proceeds to trial in order for the court to decide how to deal with the issues in dispute.
During the litigation process either party may elect to make a settlement offer.
